A DAY TO REMEMBER // Win Long Running Legal Battle


A Day To Remember have won their long running lawsuit against former label, Victory Records.

An Federal Jury in Illinois has ruled in favour of the band, ending their long running legal battle that began back in 2011. The band alleged a breach of contract, disputed ownership of the bands copyrighted works, and withheld royalties among other charges.

Victory Records however, argued the band had terminated their contract before fulfilling the agreed requirements, the contract stated the band needed to deliver five albums. Victory argued that re-releases, live recordings and bonus tracks did not as fulfilments to the contract.

Law360.com, a Chicago based legal website, released a report stating the two-week jury trial ended Tuesday the 23rd of November. The 8-person jury returned a multi-page verdict, mostly in the band’s favour.

While the jury found that most of the recordings the band claimed as fulfilment did not count as recordings under the contract, they were convinced two filmed concerts released via iTunes/Deluxe Edition albums, did. This fulfilled the bare minimum of ADTR’s contractual obligations, releasing For Those Who Have Heart live show deluxe album, Homesick live show deluxe album and What Separates Me From You.

Victory has been ordered to pay $4 million in unpaid royalties and withheld proceeds from digital downloads and merchandise sales.
