Davenport, alongside his cohort Cynthia Rawlinson, is charged with conspiracy to commit mail and wire fraud in an investigation into the operation of a telemarketing real estate scam that stole over $27 million from over 100,000 people from 2009 to 2016.

The ongoing investigation also saw the scam affect over one hundred victims in the Southern Illinois area, where The Ataris are from. The indictment alleges that the accused operated a telemarketing business, based in Santa Barbara, that had various names but the most common was ‘American Standard’.

The company would place ads on Craigslist that claimed to show ‘pre-foreclosure’ houses for sale at below market prices. Then when victims enquired about the ad, they were told they had to pay a fee of $199 to access all of the property’s information.

The customers could also purchase the houses by taking over the homeowners mortgages and the deeds would then be transferred, according to the indictment papers.

It was also alleged that after the victims paid the fee, they learned the houses were in fact, not for sale and at times didn’t even exist at the addresses listed. Then when the customer asked for their money back, they were advised to wait 90 days, then mail a refund request to American Standard along with five copies of letters from property owners proving the incorrect listings. And of course, refunds were not provided.

Davenport was listed as the owner of American Standard and when he was arrested last month more than US$104,000 was seized from him in Little Rock, Arkansas. The federal police are also in the process of securing another US$850,000 in his personal bank accounts.

Davenport and Rawlinson are set to be arraigned this Wednesday (17 January) in St Louis, Missouri.
